Terms and Conditions for Forest School and Beekeeping Experiences
Definitions and Interpretation
1.1 In these Terms and Conditions, unless the context otherwise requires, the following expressions shall have the following meanings:
“Business” means any business, trade, craft, or profession carried on by You or any other person or organisation;
“Consumer” means an individual who receives or uses services from Us for personal use and not for the purposes of any Business, as defined by the Consumer Rights Act 2015;
“Forest School session” means any group session at which We provide or lead teaching, instruction, or other services, including all facilities, equipment, and materials used in connection with the session;
“Beekeeping Experience” refers to any session involving interaction with bees and beekeeping activities;
“Our premises” refers to the location of Forest School and Beekeeping Experiences at Beacon Hill, Little Baddow, Chelmsford, CM3 4RT;
“Price List” means Our standard price list for all services, available on Our website;
“Consent Form” refers to the form You must complete to attend any session, agreeing to these Terms and Conditions;
“Regulations” refers to The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013;
“We/Us/Our” refers to Woodland Wellness, located at Beacon Hill, Little Baddow, Chelmsford, CM3 4RT, including all Our staff and agents;
“You/Your” refers to an individual who has agreed to attend a Forest School session or Beekeeping Experience.
1.2 Words denoting the singular number include the plural, and vice versa. References to gender include all genders. The headings in these Terms and Conditions are for convenience only and do not affect interpretation.
Consent Form
2.1 To attend any Forest School or Beekeeping Experience, You must complete a Consent Form and agree to these Terms and Conditions.
2.2 The details You provide in the Consent Form must be complete and accurate, including confirmation that You are 18 or over, are a “Consumer,” and agree to these Terms and Conditions, including health and safety matters and specific rules outlined in Clauses 6 and 7.
2.3 A binding contract is formed only upon Our acceptance of Your Consent Form and booking. We reserve the right to accept or reject Your form at Our discretion.
Booking and Cancellation
3.1 You must be 18 or over and a “Consumer” to book. Children may attend with an adult.
3.2 Forest School and Beekeeping sessions are subject to availability. Places are allocated on a first-come, first-served basis, and We do not guarantee any specific date or time unless booked and paid for in advance.
3.3 Bookings can be made in person, via email, phone, or through Our online system.
3.4 A session will only be provided once We have received payment and confirmed your booking. If a session is fully booked, We may place You on a waitlist and notify You of availability.
3.5 You must use your booking within two months of payment. If not, the session will be forfeited, and no refund will be issued unless cancelled under these Terms and Conditions.
3.6 Your booking is treated as an offer, and We may accept or reject it at Our discretion. A binding contract is formed once We accept and confirm your booking.
3.7 All bookings must be paid in advance. If You cancel without at least 24 hours' notice, We reserve the right to retain part or all of the payment.
3.8 If You fail to attend, We may treat it as a cancellation and charge You for the session as per Clause 3.11.
3.9 Cancellations are free of charge if You provide at least 24 hours’ notice. Refunds will be issued unless You request to rebook instead.
3.10 Failure to provide 24 hours' notice will result in a charge for the full session or any loss incurred.
3.11 In exceptional cases, such as illness or bereavement, We may waive the cancellation charge at Our discretion.
3.12 We may cancel a session if the minimum number of participants is not met, the Forest School Leader is unavailable, or due to circumstances outlined in Clause 8. We will refund any payments made.
3.13 If a session is delayed by 20 minutes or more, You may cancel and receive a full refund.
3.14 Prices and availability may change, but any price increase will not affect already booked sessions.
3.15 We reserve the right to expel You from a session if your conduct is deemed disruptive or harmful to others. No refund will be issued for expulsion after a session begins.
3.16 You have the right to cancel within 14 days of booking, in line with the Regulations, unless the session takes place within this period, in which case cancellation is not possible. Cancellations must be made in writing.
Fees and Payment
4.1 You must pay in accordance with Our Price List for all sessions provided.
4.2 Payments can be made through Our online booking system or other methods specified by Us.
4.3 We may alter Our prices without notice, but price changes will not apply to already booked sessions.
Eligibility to Participate
5.1 Only Consumers are eligible to book. By completing the Consent Form, You confirm your eligibility.
5.2 If We determine that You are not a Consumer, We may cancel your booking without liability.
Health and Safety
6.1 Participation in Forest School sessions or Beekeeping Experiences involves inherent risks, including physical activity and potential exposure to environmental hazards. You acknowledge these risks, including the possibility of injury or illness, even in the absence of negligence.
6.2 Some sessions may not be suitable for individuals with specific medical conditions. You are responsible for ensuring your own fitness to participate.
6.3 If You have any health concerns, You must seek medical advice before attending and notify Us at least 48 hours in advance.
6.4 If You have any conditions that may affect participation, You must disclose these to Us in advance.
6.5 We may exclude You from participation if You attend under the influence of alcohol or drugs, without refund.
6.6 For safety reasons, please arrive at least 10 minutes before the session starts. If delayed, notify Us in advance.
6.7 In the event of an emergency (e.g., fire), follow staff instructions and proceed to the designated assembly area.
6.8 Beekeeping Disclaimer: While We take all reasonable precautions, You acknowledge that beekeeping sessions may involve the risk of bee stings. You accept full responsibility for any injury resulting from bee stings and release Us from any liability in this regard.
Rules
7.1 Mobile phones must be set to silent during sessions to avoid disturbance.
7.2 Appropriate clothing, including long trousers, long sleeves, and sturdy footwear, must be worn at all times.
7.3 Please park your vehicle on Our property, not on The Ridge.
Events Beyond Our Control
8.1 We will not be liable for any failure or delay in performing Our obligations due to events beyond Our reasonable control, such as natural disasters or government action.
8.2 In such cases, We will notify You and offer a refund or rescheduling options.
Limitation of Liability
9.1 We are liable for any foreseeable loss or damage caused by Our breach of these Terms or Our negligence.
9.2 We are not liable for any indirect damages, including loss of profit or business.
9.3 We are not responsible for the safety of personal belongings unless caused by Our negligence.
Changes to Terms and Conditions
We may modify these Terms and Conditions and will notify You of any significant changes.
Data Protection
We will handle your personal data in accordance with Our Privacy Notice.
Regulations
We will provide all required information under the Regulations before a contract is formed.
Complaints
For any complaints, please contact Jennifer Doggett at Our premises.
No Waiver
Failure to exercise rights under these Terms and Conditions does not waive those rights.
Severance
If any provision of these Terms and Conditions is found to be invalid, the remainder shall remain in full force.
Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes will be subject to the jurisdiction of the courts in England, Wales, Scotland, or Northern Ireland.
